简论以论证型式为中枢的法律逻辑

摘　　要：新兴学科以及传统学科的新发展,促成了逻辑的新转向或新逻辑观。按照新逻辑观,人们的目标任务及其相应的环境条件,决定了不仅论证是多样化的,评估标准也是多元的。这个基本观点是关注和探究第三推理方式——论证型式的自然结果。它不仅消解了逻辑和经验的对立,也为法律逻辑的两难提供了解决之道。以论证型式为中枢的新逻辑——“型式逻辑”,为法律逻辑提供了合适框架。法律适用、法律事实证明和法律解释的论证型式,构成以论证型式为中枢的法律逻辑的三个主要方面。The new development of new disciplines and traditional disciplines leads to the new turn of logic or a new logic view.According to the new logical view,people’s goals and tasks and their corresponding environmental conditions determine that not only the argument is diversified,but also the evaluation criteria are diverse.This basic point of view is the natural result of focusing on and exploring the third type of reasoning,the argument scheme.It not only eliminates the opposite between logic and experience,but also provides a solution to the dilemma of legal logic.“Scheme logic”,a new logic centering on argumentation,provides a suitable framework for legal logic.The argument schemes of law application,legal fact proof and legal interpretation constitute three main aspects of legal logic centering on argument schemes.
