摘　　要：法治反腐作为腐败治理的一种理性选择,其规范意蕴在于以“法”为据、以“治”为功,通过惩治和预防腐败,建设廉洁政治。从法治反腐看党内法规制度建设,实质是从党内腐败治理检视党风廉政建设法规制度建设状况,以此检视是否形成了反腐败法规制度体系化,是否有效遏制了腐败,形成了“不敢腐、不能腐、不想腐”的有效机制。在新的历史起点上推进党内法治反腐,须从体系化与效能论视角,更好地思考党内法规制度建设问题,即秉持法治的精神高质量建设党内法规制度;坚持制度供给侧结构性改革思维推动实现反腐倡廉法规制度体系化,形成制度整体效应;妥善处理法规制度的制定和实施,更好地推动党内腐败治理的制度优势转化为治理效能。As a rational choice for corruption prevention,the normative meaning of anti-corruption by the rule of law is to build clean politics by taking the“law”as the basis and the“governance”as the aim,and by punishing and preventing corruption.The essence of construction of inner-Party laws and regulations as viewed from the perspective of the rule of law and anti-corruption,is to examine the construction of improving the Party working style,boosting clean governance as well as that of laws and regulations,so as to examine whether anti-corruption laws and regulations have been systematized,whether corruption has been effectively curbed,and a mechanism of“not daring to corrupt,not being able to corrupt,and not wanting to corrupt”has been formed.To promote the rule of law and anti-corruption within the Party at a new historical starting point,it is necessary to consider the construction of the inner-Party laws and regulations from the perspective of systematization and effectiveness,that is,to uphold the spirit of the rule of law and build a high-quality inner-Party anti-corruption and clean governance regulatory system,and to adhere to the supply-side structure reform in order to promote systematization of anti-corruption and clean governance laws and regulations,and form the overall effect of the system.In addition to that,appropriate handling of the enactment and implementation of laws and regulations will better accelerate the turn of anti-corruption and clean governance regulatory system advantages to efficient state governance.
