整体主义视角下监察权的规范基础与拓展路径

摘　　要：纪检监察合署办公共同构筑起反腐败治理体系现代化的制度目标。在整体主义视角下,监察权的规范表达既要体现党在反腐败领域的领导地位,又要借助国家权力体系阐释监察权的功能定位。监察权具有政治权威性和法律权威性,在连通党纪国法中发挥着党内监督与国家监督一体化的调整功能、权力监督制约的规范功能、扭转政治生态的保障功能以及净化公权力行使环境的惩戒功能。在新的历史起点持续深化国家监察体制改革,应坚持以党领导下的国家监察改革目标为逻辑起点,不断优化监察权运行的体制机制,提升监察权运行的法治化水平,健全监察权与党和国家监督体系的融合,推动监察权在国家治理现代化中的功能拓展。The joint duty execution of discipline inspection committees and supervision offices has established the institutional modernization goal for anti-corruption efforts. Based on the perspective of holism, the standard expression of supervisory power must not only reflect the political status of the Party in the field of anti-corruption, but also explain the functional positioning of supervisory power with the aid of the state power system. The power of supervision is politically and legally authoritative, in linking Party discipline and state law, playing the role of adjusting the integration of internal Party supervision and state supervision, the standard function of power supervision and restriction, the guaranteeing function of reversing the political ecology, and the disciplinary function of purifying the environment for exercising public power. To continue to deepen the reform of national supervision system at a new historical starting point, we should adhere to the goal of national supervision reform under the leadership of the Party as the logical starting point to continuously optimize the system and mechanism for the execution of supervision power, improve the level of rule of law, improve the integration of supervision power and Party and state supervision to promote the expansion of supervisory power in the modernization of national governance.
