摘　　要：数字网络环境下传统著作权授权许可机制难以满足使用人对海量作品的使用需求,导致网络著作权侵权纠纷频发,进一步滋生了网络著作权滥用的“钓鱼维权”行为。运用民法默示许可制度对网络著作权进行适当限制,完善著作权授权许可模式,从而铲除著作权滥用行为的温床,不仅具有理论依据,也有现实基础。网络著作权的默示许可是与法定许可和合理使用相并立的限制制度,因此应当限定其适用规则,以确保著作权法立法目的的实现。Under the digital network environment,the traditional copyright authorization and licensing mechanism is difficult to meet the users'needs for massive works,resulting in frequent online copyright infringement disputes,and further breeding the“phishing rights protection”behavior of online copyright abuse.It has not only a theoretical basis,but also a practical basis to properly restrict the online copyright system and improve the copyright licensing mode,so as to eradicate the hotbed of copyright abuse.The implied license of online copyright is a restriction system consistent with the legal license and reasonable use,so its application rules should be limited to ensure the realization of the legislative purpose of copyright law.
