摘　　要：当前监察案件录音录像制度实践存在“调取难”问题,其原因可以总结为法院裁量权规则设定和录音录像规则设定的不完整。监察案件录音录像制度的理论构建和法律实践对案件中证据合法性的确认有重要的意义。目前的《监察法》及相关规定在践行程序正义理念和落实诉讼权利保障方面存在待完善之处,相关证据合法性的判断标准也需要更加具体化。The reasons that audio and video recordings in supervisory cases are difficult to be obtained include the incomplete setting of court discretion rules and recording rules. The theoretical construction and legal practice of audio and video recording system are of great significance to the confirmation of evidence legality in supervisory cases.The practice of procedural justice concept and the protection of litigation rights should be improved in current Supervision Law and relevant regulations. And the judgment standard of evidence legitimacy should be more specific.
