摘 要:自20世纪八九十年代人民法院开展信息化建设以来,司法信息化建设取得了明显成效。肇始于特定历史背景之下的法院信息化,已经并将继续对中国法院产生各种影响。信息化改变了法院系统的信息联结机制,强化了上级法院向下“汲取”司法信息的能力;信息化提供了多样化的办案工具选择,对于提升司法效率以及办案质量亦有明显助益;信息化重塑了传统的司法管理机制,对司法管理主体及管理对象的影响与日俱增。然而,信息化也造成了上级法院对下级法院司法工作更频繁、更深入的介入和干预,下级法院及办案人员也利用各种方式来规避上级法院的“监管”。展望未来,信息化应在人的能动性与技术治理逻辑之间寻求更好的平衡。Since people's courts started informatization in the 1980s and 1990s,the informatization of people's courts has made significant achievement.The informatization of courts,which started under a specific historical background,has and will continue to have various impacts on Chinese courts.The empirical investigation found that informatization has improved the internal communication mechanism of the people's courts and strengthened the ability of higher courts to“absorb”judicial information from the lower courts.Informatization provides flexible mechanisms for case handling,which is also obviously helpful for improving judicial efficiency and quality of case handling.Informatization has reshaped the traditional judicial management mechanism,and its influence on judicial management subjects and management objects is increasing.However,informatization has also resulted in more frequent and deeper intervention by higher courts in the judicial work of lower courts.Lower courts and case handlers have also used various methods to circumvent the“supervision”of higher courts.In the future,informatization should seek a better balance between human initiative and technological governance logic.
