网络信息内容监管约谈的制度异化与再定位

摘　　要：行政约谈是位于“执法金字塔”底层的柔性规制工具,旨在预防风险和促进行政机关和行政相对人的沟通协商。行政约谈因其柔性规制的特点成为网络信息内容监管的重要工具,但由于网络信息内容监管领域执法主体分散、执法资源有限以及执法义务平台化,在网络信息内容约谈制度设计上体现了“以问题为中心”的导向,在具体实践中导致约谈适用过度化与强制化。鉴于行政约谈在网络信息内容监管领域的适用偏差,需要明晰行政约谈的制度设计与功能定位的原初意涵,再基于行政约谈的适用原意审视当前的网络信息内容监管领域的适用偏差,最后从“行政过程论”的角度理解网络信息内容监管领域的行政约谈,实现约谈工具的角色复归。Administrative interview is a flexible regulatory tool at the bottom of the regulatory pyramid,which aims to prevent risks and promote consultation between administrative agency and administrative counterparts.Due to the characteristics of flexible regulation,administrative interview has become an important tool for Internet content regulation.However,due to the scattered law enforcement subjects,limited law enforcement resources and platform commitment of law enforcement obligations in the field of Internet content regulation,Internet content interview is a problem centered system design,which leads to the over application and coercion of interview in specific practice.Given the application deviation of administrative interview in the Internet content regulation,it is necessary to clarify the original meaning of the system design and functional positioning of administrative interview,then examine the application deviation in the Internet content regulation based on the application original meaning of administrative interview,and finally understand the administrative interview in the Internet content regulation from the perspective of Administrative Process theory to realize the original value of interview tools.
