摘 要:在当前大数据等金融科技飞速发展的时代,个人征信信息采集范围有逐步扩大的趋势,征信信息采集引发社会高度关注。分析我国个人征信信息采集的现状,发现存在法律法规不完善、界限不清晰、行为不规范和标准不统一等问题,并借鉴发达国家个人征信管理的成熟经验,提出从加强法律法规制度供给、明确采集范围、打击非法行为、制定采集技术标准和实施行业自律管理等五方面规范大数据时代我国个人征信信息采集的对策和具体路径。In the current era of rapid development of big data and other financial technologies,the scope of personal credit information collection is gradually expanding,and the collection of credit information has aroused high social concern.By analyzing the current situation of imperfect laws and regulations,unclear boundaries,non-standard behaviors and inconsistent standards in personal credit information collection in China,and drawing lessons from the mature experience of personal credit information management in foreign developed countries,this paper puts forward countermeasures and specific paths to regulate the collection of personal credit information in China in the context of big data era from five aspects:strengthening the supply of laws and regulations,clarifying the collection scope,cracking down on illegal behaviors,establishing collection technical standards and implementing industry self-regulation.
