摘　　要：文章从发明专利等同侵权判断方法出发,分析了其中的现存问题,并通过司法实践中的相关案例,论述了引入“发明目的”的必要性,展示其在专利等同侵权判断中的重要作用。此外,文章结合司法审判案例还论述了专利等同侵权判断的限制规则。Starting from the judgment method of equal infringement of invention patent,this paper analyzes the existing problems,discusses the necessity of introducing"invention purpose"through relevant cases in judicial practice,and shows its important role in the judgment of equal infringement of patent.In addition,combined with judicial cases,the article also discusses the restriction rules of judgment of patent equivalent infringement.
