摘　　要：习近平法治思想坚持和运用马克思主义的世界观和方法论,科学透视了全面依法治国中的一系列重大关系,在其中居于首位的便是政治和法治的关系。在习近平法治思想的理论框架中,政治和法治关系的辩证思维呈现为从一般到特殊的三个层次。一是从一般意义上阐明了政治和法治关系中普遍的政理逻辑,史论结合地论述了法治形态背后的政治理论、法治模式当中的政治逻辑、法治道路下的政治立场。二是立足中国现实指出了党法关系是政治和法治关系的集中体现,既实事求是分析了党的领导和社会主义法治的一致性,又正本清源破除了割裂党法关系的错误认识。三是结合具体实践剖析了党的政策和国家法律本质相通、功能互补的统一关系,展示了党法关系在中国法治建设中的实践具象。Xi Jinping Thought on the Rule of Law adheres to and applies the world outlook and methodology of Marxist materialist dialectics,and scientifically looks into a series of major relationships in comprehensively governing the country according to law,among which the relationship between politics and rule of law is the first.In the theoretical framework of Xi Jinping Thought on the Rule of Law,the dialectic of the relationship between politics and the rule of law is presented at three levels,from general to special.Firstly,in a general sense,it clarifies the universal political logic in the relationship between politics and the rule of law,and combines historical theory to discuss the political theory behind the form of rule of law,the political logic in the rule of law model,and the political position under the road of rule of law.Secondly,based on China’s reality,it points out that the relationship between the party and the law is a concentrated embodiment of the relationship between politics and the rule of law,which not only analyzes the consistency of the party’s leadership and the socialist rule of law,but also breaks the erroneous understanding of the relationship between the party and the law.Thirdly,in combination with specific practice,it analyzes the unified relationship between the party’s policies and state laws,and shows the practical embodiment of the Party-law relationship in the construction of the rule of law in China.
