摘　　要：党的十九届五中全会明确提出“实施积极应对人口老龄化国家战略”。面对我国不断变化的人口情势,加强法治保障是国家积极应对人口老龄化战略的必然选择,也是其客观的治理过程。在老龄化日益严峻的背景下,积极应对人口老龄化战略法治保障面临观念障碍、体系失衡与断裂、“制度性”不强、贯彻失灵等现实困境。在新时代确保积极应对人口老龄化国家战略顺利实施,要积极探索适应经济社会发展和人口老龄化进程的法治路径,以法治思维和法治方式化解老龄风险,完善积极应对人口老龄化法治体系架构,健全积极应对人口老龄化法律制度,促进形成积极应对人口老龄化法治实施方略,从而构建具有中国特色的积极应对人口老龄化法治保障道路。The Fifth Plenary Session of the19th CPC Central Committee definitely put forward“the implementation of the national strategy to actively respond to population aging”.In the face of China.s changing population situation,strengthening the legal rule-of-law guarantee is not only the inevitable choice to actively respond to the population aging strategy,but also the objective governance process by its nature.In the context of increasingly severe aging,we are supposed to actively find solutions to ruleof-law guarantee of population aging strategy so as to handle practical difficulties,such as conceptual obstacles,system imbalance and collapse,weak“institutionalization”,implementation failure,etc.In the new era,to ensure the smooth implementation of the national strategy to actively respond to population aging,we should actively explore the path of the rule-of-law fit for economic and social development and the process of population aging,resolve the risks of aging with the thinking and way of the rule-of-law,improve the framework of the rule-of-law system and the legal system,and promote the formation of an implementation strategy of the rule-of-law to actively respond to population aging,so as to build a path of rule-of-law guarantee with Chinese characteristics.
