理论困境、衔接空间与应然限度:监察从宽处罚建议的程序衔接探讨

摘　　要：认罪认罚从宽集中呈现了刑事诉讼的效率价值,为刑事简易程序和速裁程序的顺畅运行提供了制度依据。针对职务犯罪案件,监察机关调查终结后可向刑事司法机关提出从宽处罚建议,这同检察机关量刑建议程序在程序逻辑、适用标准与规制效果等方面产生竞合。从宽处罚建议与量刑建议在程序衔接上具备立法完善的必要性,主要表现为主体职责上具备关联性,建议内容上具备共通性,适用阶段上具备承继性以及运行效果上具备兼容性。立法应厘清监察机关不移送审查起诉与检察机关不起诉之间的关系,明确监察从宽处罚建议的程序裁量限度,在审查起诉阶段强化检察机关对从宽处罚建议的实质审查义务。The leniency system of confession and punishment shows the efficiency value of criminal proceedings from a broad perspective,which provides an institutional basis for the smooth operation of criminal summary procedure and quick adjudication procedure.In view of duty crime cases,the supervisory organs can put forward lenient punishment suggestions to the criminal judicial organs after the investigation,which competes with the sentencing suggestion procedures of procuratorial organs in terms of procedural logic,applicable standards and regulatory effects.It is necessary to perfect the legislation between leniency punishment proposal and sentencing proposal,which is based on the relevance of main responsibilities,the commonality in proposal content,inheritance in application stage and compatibility in operation effect.Legislation should clarify the relationship between the supervisory organ’s non-referral for examination and prosecution,the procuratorial organ’s non-prosecution,clarify the procedural discretion limit of monitoring leniency punishment suggestions,and strengthen the procuratorial organ’s substantive examination obligation of leniency punishment suggestions in the stage of examination and prosecution.
