共同富裕与法治——宪法“社会主义法治国家”条款的融贯解释

摘　　要：共同富裕是社会主义的本质要求,对它的法治保障应以《宪法》第五条第一款规定的“社会主义法治国家”为宪法基础。不过,“社会主义”的共同富裕本质与“法治国家”的个人自由底色共同塑造了这一宪法概念的内在张力,对于两者紧张程度的不同理解或将对我国共同富裕法治建设的基本方向造成根本影响。为此,通过借鉴德国公法学说,本文拟通过融贯解释,在自由与平等的对立统一中调适社会主义法治国家的规范内涵。以社会主义法治国家为指导,我国的共同富裕法治建设应以个人自由与财产的安全保障为前提,以坚持市场经济体制、解放生产力为物质基础,以形式法治为制度保障,以“原则模式”为实现方式,遵循循序渐进的发展规律,在自由与富裕的基础上为实现社会平衡、维护社会公平正义提供系统、全面的法治保障。Common prosperity is the essential requirement of socialism,and its legal protection should be based on the“socialist country under the rule of law”stipulated in the first paragraph of Article 5 of the Constitution.Among them,the common prosperity nature of“socialism”and the background of individual freedom of the“country under the rule of law”shaped the inherent tension of the constitutional concept.Different understandings of the tension between the two may directly impact the basic direction of the legal construction of the common prosperity of China.For this reason,this article attempts to adjust the normative connotation of the socialist country under the rule of law by coherent interpretation in the unity of opposites of freedom and equality by referring to German public law theory.Under the guidance of the socialist country under the rule of law,the legal construction of common prosperity in China should protect the security of individual freedom and property as the premise,uphold the market economy system and liberate the productive forces as the material basis,take the formal rule of law as the system guarantee,take the“principle model”as the implementation method and follow the law of gradual development so as to provide a systematic and comprehensive legal protection for the realization of social balance and the maintenance of social fairness and justice on the basis of freedom and prosperity.
