摘 要:“仪式性人情”的异化是“乡风文明”建设的巨大阻碍,表现为经济功能和社会功能的异化,由曾经的互助机制演变为敛财工具,其根本原因在于乡村原有秩序的消解,无法充分发挥“活法”的规制功能。“仪式性人情”的无序发展已不能通过乡村的自我能力重构,村民的伦理诉求和乡村内部力量微弱等原因构成了公权嵌入式治理的道德正当性,但政府在治理过程中依然欠缺合法性依据。基于地方性法规和地方政府规章权限和特性的全面考虑,应当优先选择制定地方政府规章,进而型塑对“仪式性人情”乱象的依法而治;此外,还应高度重视村规民约作为“活法”的作用,形成多元法律治理的格局。The alienation of"ritual human feelings"is a huge obstacle to the construction of"rural civilization",which is manifested in the alienation of economic and social functions,and has evolved from the mutual aid mechanism to a tool for collecting money.The fundamental reason lies in the dissolution of the original rural order and the inability to give full play to the regulatory function of"living law".The disorderly development of"ritual human feelings"can no longer be reconstructed by the self-ability of the countryside.The ethical demands of the villagers and the weak internal forces of the countryside constitute the moral legitimacy of the embedded governance of public rights,but the government still lacks the legal basis in the process of governance.Based on the comprehensive consideration of the authority and characteristics of local laws and regulations and local government regulations,we should give priority to the formulation of local government regulations,so as to shape the rule of law against"ritual human feelings"chaos.In addition,we should attach great importance to the role of village rules and regulations as a"living law"and form a pattern of multi-legal governance.
