摘 要:福柯刑罚思想充满了权力迷思,其核心在于政治权力主导刑罚制度发展,正是政治权力塑造了不同时代的刑罚形象,决定了刑罚产品的时代性生产。福柯认为从古典时期到现代时期,刑罚的功能定位与惩罚策略出现了四个方面的根本性转变:一是惩罚目的不再是消灭肉体而是再造受刑者;二是惩罚技术从暴力与镇压向规训与矫正转变;三是惩罚意象由断头台演变为现代环形监狱;四是惩罚载体从以身体控制为主的一元模式向以自由、权利为载体的多元模式转型。这一系列的转变既保障了国家刑罚权力对受刑者的成功再造,也完美塑造了文明理性的国家刑罚形象。The myth of power can be spotted throughout Foucault’s penal thoughts.Foucault’s penal thought is full of power myth, The core of which lies in the argument that political power drives the development of the penal system, and the political power shapes the image of penalty in different times and determines the production of penalty products in different times. Foucault believes that from the classical period to the modern period, the function and punishment strategies of penalties have undergone fundamental changes in four aspects. First, the purpose of penalties is no longer physical punishment but the rehabilitation of the victim. Second, the punishment technology is changing from violence and repression to discipline and correction.Third, the image of punishment has changed from the guillotine to the modern ring prison.Fourth, the carrier of punishment has transformed from body control, a single carrier, to freedom and rights restriction, a diversified mode. This series of changes not only guarantees the reconstruction of the state penalty power to the prisoners, but also shapes the civilized and rational national penalty image.
