挪威监狱刑罚执行的理念、体系及对我国的启示

摘　　要：挪威监狱秉持社会化、法治化、人道化、轻刑化和个别化的行刑理念。行刑前的刑罚分流处置、社区刑罚对监禁刑的补充以及行刑后对罪犯的帮困扶助构成了挪威立体化的刑罚执行体系,并在实践中取得了较好的罪犯监管和改造效果。挪威监狱刑罚执行的理念和体系给我们带来了一定启示。未来可在结合我国国情的基础上,从推动监狱行刑与社区矫正一体化、加强监狱行刑的社会化、完善监狱分级分类建设与罪犯分级分类管理以及促进刑罚执行现代化等方面完善我国行刑工作。The philosophy of penalty execution of Norwegian prison includes reintegration orientation, rule of law, humanization, light punishment and individualization. The penalty execution system in Norway which is composed of the division of punishment before execution,the supplement of community punishment to prison imprisonment and the assistance to discharged prisoners, has had a fairly positive effect on the management and correction of inmates. The philosophy and system of prison penalty execution in Norway is enlightening to China. Based on the condition of our own country, we can improve the penalty execution in China by promoting the integration of prison execution and community correction, strengthening the cooperation between prison and society and the reintegration of prisoners, improving the prison and the inmate classification, and promoting the modernization of penalty execution in the future.
