摘　　要：在传统命令型、禁止型法律规制模式下,非国有重要档案保护管理面临着信息不对称、执法资源稀缺、利益失衡等难题,制约着档案规制正义和私权保障的有效实现。在非国有重要档案保护管理法律制度中嵌入激励性法律规制能够有效破解非国有重要档案所有权自由与公益限制的博弈困境,凸显非国有重要档案的财产权价值,促进档案治理的公私合作。实现非国有重要档案保护管理法律制度体系的激励相容.需要构建非国有重要档案财产权公益限制补偿机制,健全非国有重要档案申报评估及登记制度,逐步构建完善非国有重要档案流转交易保障机制。Under the traditional mandatory and prohibited legal regulation mode, the protection and management of important non-state-owned archives are facing problems such as information asymmetry, scarcity of law enforcement resources and interest imbalance, which restricts the effective realization of archives regulation justice and private rights protection.Embedding incentive legal regulation in the legal system for the protection and management of important non-state-owned archives can effectively solve the game dilemma between the freedom of ownership and public welfare restrictions of important non-state-owned archives, highlight the property value of important non-state-owned archives, and promote the public-private cooperation of archives governance.To realize the incentive compatibility of the legal system for the protection and management of important non-state-owned archives, we need to build a public welfare restriction and compensation mechanism for the property rights of important non-state-owned archives, improve the application, evaluation and registration system of important non-state-owned archives, and improve the circulation and transaction mechanism of important non-state-owned archives.
