摘　　要：《资本论》及其手稿在论述资本主义社会的内在矛盾与经济规律的过程中,对法与经济的关系做出了重大揭示,解蔽了资本主义的“法的现象”,揭示出法律产生的经济根源、法律内在的经济本质和法律变革的经济动因。《资本论》及其手稿中蕴含的法与经济关系的思想具有重要的现实启示意义。在新时代经济建设与法治建设协同发展的过程中,既要重视经济因素在社会主义发展过程中的根本性、决定性意义,又要在经济改革的同时注重法治建设。市场经济法治建设应当重视劳资关系的改善和契约精神的培育。法治文化的发展要注意处理好法律移植与法律继承之间的关系。While discussing the inherent contradictions and economic laws of capitalist society, Das Kapital and its manuscripts reveal the relationship between law and economy. The“phenomenon of law”of capitalism is overtly announced, and the economic root of law is disclosed, together with the inherent economic essence of law and the economic motivation of law reform. The thoughts of law and economic relationship contained in Das Kapital and its manuscripts have great significance of practical enlightenment. In the process of synergetic development of economic construction and rule of law, great importance should be attached to not only the fundamental and decisive significance of economic factors in the process of socialist development, but the legal construction in the economic reform. For one thing, the legal construction of market economy should attach importance to the improvement of labor-capital relations and the cultivation of contract spirit. For another, the development of legal culture should concentrate on the relationship between legal transplantation and legal inheritance.
