摘　　要：本文通过分析旧版《档案法》背景下未开放档案权利救济的实现情况,发现存在主诉人认知错位、法院常驳回行政诉讼请求、缺乏法律规制等三重困境;通过梳理新修订《档案法》中增改的有关未开放档案权利救济的直接和间接规定,分析得出仍存在主体、途径、法律实现与流程四个层面的不足。针对新修订《档案法》仍未解决的困境与现存的不足,本文提出了厘清主体属性、补充救济途径、完善法律法规、细化救济流程等四方面的具体改进策略。By analyzing the realization of the right to unopened archives in the background of the old archives law, this paper finds three predicaments as the cognitive dislocation of the main plaintiff, the frequent rejection of administrative litigation by the court, and the lack of legal regulation. By combing through the direct and indirect provisions of the new revised archives law, in the author’s opinion, there are still four deficiencies in this subject,approach, legal realization and process. Aiming at the still unsolved predicament and the existing deficiency, this paper puts forward four specific improvement strategies, such as clarifying the main property, supplementing the relief way, perfecting the laws and regulations, and refining the relief process.
