摘　　要：在《国有土地上房屋征收与补偿条例》实施以后,房屋产权调换的法律关系由拆迁人与被拆迁人之间的民事法律关系向征收人与被征收人之间的行政法律关系过渡。同时,由于《城市房屋拆迁管理条例》中房屋拆迁法律关系的持续性,使得当前房屋产权调换法律关系形成了民事法律关系与行政法律关系并存的局面。明晰当前房屋产权调换法律关系的性质及多元化权利属性,不仅有益于保障平等民事主体或行政相对人的合法权益,而且可以促进行政机关规范行政行为,依法履行行政职能,进而发挥房屋产权调换制度的应有价值。基于房屋产权调换中存在的协议主体不明确、权利内容不稳定、权利保障机制不健全等现实困境,可从注重法律关系主体的稳定性、落实行政主体监督职责以及发挥物权期待权的制度价值等角度实现房屋产权调换中合法权利的保护。After the implementation of the Regulations on House Expropriation and Compensation on State-owned Land,the legal relationship of house property right exchange has changed from the civil legal relationship between the demolisher and the demolished to the administrative legal relationship between the expropriator and the expropriated.At the same time,due to the continuity of the legal relationship of house demolition in the Regulations on the Administration of Urban House Demolition,the current legal relationship of house property right exchange has formed the coexistence of civil legal relationship and administrative legal relationship.Clarifying the nature of the current legal relationship of house property right exchange and the attribute of diversified rights will not only help to protect the legitimate rights and interests of equal civil subjects or administrative counterparts,but also promote the administrative organs to standardize administrative acts and perform administrative functions according to law,so as to give full play to the due value of the house property right exchange system in the context of the new era.In this context,based on the practical difficulties such as unclear agreement subject,unstable right content and imperfect right protection mechanism in the exchange of house property rights,the protection of legal rights in the exchange of house property rights can be realized from the perspective of paying attention to the stability of legal relationship subject,implementing the supervision responsibility of administrative subject and giving full play to the institutional value of real right expectation right in the future.
