网约车聚合模式规范发展问题研究

摘　　要：网约车聚合模式迅速发展,对于提高运输效率、促进市场竞争、规范中小平台企业经营行为具有积极作用。文章在系统梳理聚合模式发展基本情况的基础上,总结了目前存在的定位不明且无标准、平台经营行为不规范、数据传输存在缺失、乘客权益缺乏保障等问题,并结合《电子商务法》以及《网络交易监督管理办法》等有关规定,明确网约车聚合平台属于电子商务平台的法律定位,分析了网约车聚合平台应在经营服务过程中做到严格经营资质审核、保障乘客合法权益、做好信息公示、维护市场公平竞争环境、保证传递信息准确、建立服务质量考核制度、保护网络安全和用户个人信息安全等义务,并提出了明确发展定位、规范经营行为、落实主体责任、创新监管方式等政策建议。The rapid development of ride-hailing aggregation mode plays a positive role in improving transportation efficiency,promoting market competition and standardizing the business behavior of small and medium-sized platform enterprises.On the basis of systematically combing the basic situation of the development of aggregation mode,this paper summarizes the problems existing at present,such as unclear positioning and no standard,non-standard platform business behavior,lack of data transmission,lack of protection of passengers’rights and interests,and combined with the relevant provisions of the e-commerce law and the measures for the supervision and administration of online transactions,It is clear that the online car Hailing aggregation platform belongs to the legal positioning of e-commerce platform.It is analyzed that the online car Hailing aggregation platform should strictly review the business qualification,protect the legitimate rights and interests of passengers,do a good job in information publicity,maintain the market fair competition environment,ensure the accuracy of information transmission,and establish a service quality assessment system Protect network security and user personal information security,and put forward policy suggestions such as clarifying development orientation,standardizing business behavior,implementing subject responsibility and innovating supervision methods。
