摘　　要：国家重点保护野生动物名录制度秉承物种“重点保护”原则,在生态伦理观指引下,因应生态文明建设的法制理念,是我国野生动物保护方面的制度创新。野生动物生存发展现状、环境法对环境内涵的立法界定及自然资源国家所有权理论,为该制度的生成与完善提供了正当性依据。但当前该制度也存在修订标准与程序缺失、管理层面不够完善及适用层面司法保障力不足等问题,导致其在新时代野生动物保护中制度功能实现受阻。为此,应从设立法定列入标准与程序、优化名录管理机制、强化名录制度司法保障等角度推进野生动物保护名录制度的法律改革,推动我国野生动物保护治理体系和治理能力现代化。The national key protected wildlife list system adheres to the principle of“key protection”of species,which is under the guidance of ecological ethics,and give response to the legal concept of ecological civilization construction.It is an institutional innovation of wildlife protection in China.The current situation of wildlife survival and development,the legislative definition of environment connotation in environmental law and the theory of state ownership of natural resources provide a legitimate basis for the generation and perfection of the system.However,there are problems of the lack of revision standards and procedures,the imperfection on management level and the insufficient judicial guarantee at application level,etc.,which hinder the realization of institutional function in wildlife protection in the New Era.Therefore,the legal reform of wildlife protection list system should be promoted from perspectives of establishing the legal inclusion standards and procedures,optimizing the list management mechanism,and strengthening the judicial guarantee of list system,so as to promote the modernization of governance system and governance capacity of wildlife protection in China.
