摘　　要：在新《著作权法》修改条款已经实施的背景下,讨论如何运用法律手段对电视节目模式进行版权保护具有极其重要的现实意义。从实践角度出发,深入解读国际风向、司法程序、行业监管三个方面,分析电视节目模式获得著作权法保护的法律困境;从问题意识出发,联系各国判例及立法经验,结合我国实际国情,研究得出电视节目模式版权保护的法律进路,以期为逐年增多的电视节目模式版权纠纷提供解决思路。Under the background of the implementation of the Copyright Law of the People’s Republic of China(2020 amendment), it is of practical significance to discuss how to use legal means to protect the copyright of TV program mode. From the perspective of practice, this paper deeply interprets the international trend, judicial procedure and industry supervision and analyzes the legal difficulties of TV program model protected by copyright law. Starting from the problem consciousness, it also studies the legal approach to the copyright protection of TV program model by combining with the actual conditions of our country’s precedents and legislative experience of other countries to provide solutions to the increasing copyright disputes of TV program model.
