摘　　要：行政信访作为信访制度的重要组成部分,其公共治理法治化改革路径的设计,难以忽略群众工作的政治路线,以上两种价值张力易割裂“自上而下”的民意汲取思路与“自下而上”的权利救济表达。应当改变以往“就信访解决信访”的思路局限,从信访制度产生、发展的历史逻辑为起点,思考“自上而下”制度进路与基层治理能力欠缺的矛盾,分析行政信访制度理论建构与实然效果的差异原因,通过信访机构及其行政官员与信访人基于理性经济假设而产生的多重博弈角度,分析政府官员绩效考核和行政信访治理视域的回归。意在理顺行政信访在群众监督的政治路线与纠纷解决的权利救济的二元价值选择的边界控制,完善其内外多角度的制度综合改革,推动行政信访工作的有效开展。As a highlight of the petitioning system,the design of the reformation path of rules and laws in public governance makes it difficult to ignore the political guideline of mass work,and the tensions between two values are easy to separate the“top-down”resources to draw public opinion from the“bottomup”expression of petition rights.Starting with the historical logic of the emergence and development of the petitioning system,the article changes the limitations of the previous thinking of“solving petitions on petitions”,and discusses the contradictions between the“top-down”system approach and the lack of grassroots governance capabilities.It also analyzes the reasons for the difference between theoretical construction and actual effect of the administrative petitioning system,as well as the performance appraisal of government officials and the return of the governance perspective of administrative petitioning through multiple game angles generated by petitioning institutions and their administrative officials and petitioners based on rational economic assumptions.It is intended to sort out the boundary control of the dual value choice of administrative petitioning in the political line of mass supervision and the right to remedy dispute resolution.The proposal tries to improve the comprehensive reformation of the system from multiple angles inside and outside,and to promote the effective resolution of administrative petitioning work.
