消防行政执法规范化标准体系构建

摘　　要：在当前消防行政执法改革关键期,结合执法规范化成果,围绕消防行政执法职权内容建立消防行政执法规范化标准体系,是深化消防行政执法改革的有效举措。分析当前消防行政职权类别和具体内容,对应消防标准体系框架,构建了消防行政执法通用标准和消防行政执法专用标准两层结构。消防行政执法通用标准包含消防行政执法术语、执法取证、执法内部程序、执法档案管理、执法质量考评以及执法人员资格;消防行政执法专用标准主要涉及消防行政许可、消防行政备案抽查、消防监督检查、消防行政处罚、消防行政强制及消防行政确认等行政执法职权的运行。研究结果为固化消防执法规范化成果提供了基本思路和实现路径。During the critical reform period,establishing a standardization system on the basis of the law enforcement standardization achievements with fire administrative law enforcement functions and powers as its content,is an effective measure to deepen the achievements of fire administrative law enforcement reform.This article analyzes the categories and contents of fire administrative functions and powers,and proposes constructing a two-layered framework of fire protection standard system including the general standards and the special standards of administration law enforcement.It mainly expounds the fire safety evaluation standards for public gathering places,the qualification standards for fire technical service organizations,the fire safety conditions for large-scale mass activities,the discretionary guidelines for fire administrative penalties,and the purpose and content of the standards for fire statistics methods.The research results can provide basic ideas and implementation paths for solidifying the standardized achievements of fire law enforcement.
