摘　　要：《商业银行法》面临再次修订。中国人民银行2020年10月发布《商业银行法》(建议修改稿),包含六方面主要修改内容。《商业银行法》(建议修改稿)第107条关于商业银行股东和实际控制人罚则的规定、第108条关于违反公司治理、资本与风险管理的规定、第109条关于索偿追回机制的规定还存在规制漏洞,需要进一步完善内容和表述。The commercial bank law is facing another revision. The people’s Bank of China issued the Commercial Bank Law(Proposed Amendment) in October 2020, including six main amendments. There are still defects in the provisions on penalties for shareholders and actual controllers of commercial banks in article 107 of the Commercial Bank Law(Proposed Amendment), the provisions on violation of corporate governance, capital and risk management in Article 108, and the provisions on claim recovery mechanism in Article 109, which need to be further improved.
