摘 要:涉外关系是国内视角的国际关系,其治理模式因时而异。在很长的历史时期内,战争是处理国际关系的决定性手段。随着《联合国宪章》禁止使用武力或武力威胁处理国际关系、要求以和平方式解决国际争端,国际关系被纳入法律治理轨道。涉外关系治理亦存在法律化必然性,但法律治理模式与其他模式仍存在密切的关系,内国在这一治理中发挥更大的主导作用。法律治理可以采取国际法、国内法和政策协调等途径。中国涉外关系的法律治理可以称为涉外法治。中国涉外法律实施应统筹国内法治和涉外法治,适当发挥法律域外适用和域外管辖的作用,维护国家主权、安全、发展利益以及全人类共同价值,在此基础上建设人类命运共同体。Foreign relations are international relations from a domestic perspective,and their modes of governance vary from time to time.For a long period of history,war was the decisive instrument in the conduct of international relations.With the United Nations Charter prohibiting the use or threat of force in the conduct of international relations and calling for peaceful methods of settling international disputes,international relations have been brought under legal governance.The legalization of foreign relations governance is also inevitable,but the legal governance is still closely related to other governance models,and the domestic regulation plays a more dominant role in this governance.Legal governance can take forms of international law,domestic law,and policy coordination.The legal governance of China’s foreign relations can be referred to as foreign-related rule of law.The implementation of China’s foreign-related law s should be integrated with domestic rule of lawand foreign-related rule of law,and give full play to the role of extraterritorial application of lawand jurisdiction to safeguard national sovereignty,security,development interests and the common values of all mankind,and build a community with a shared future for mankind on this basis.
