从新冠肺炎疫情看世界卫生组织法律制度的主要困境与改善路径

摘　　要：世界卫生组织是负责全球公共卫生治理的联合国专门机构,但是,由于其法律制度面临自身软弱、缺乏行动力、受其他国际法规则掣肘等困境,在新冠肺炎疫情肆虐时所发挥的作用十分有限。因此,坚持世界卫生组织对全球卫生治理的领导作用,设立有较强自主性的传染病防控基金提升其行动力,提升必要会费,加强与其他国际组织的资源协调,均是改善现有困境的可行路径。The World Health Organization is a United Nations specialized agency responsible for global public health governance.However,its legal system is facing difficulties such as its own weakness,lack of action and being constrained by other rules of international law.It has played a very limited role in the outbreak of COVID-19.Therefore,adhering to the leading role of the World Health Organization in global health governance,establishing a highly autonomous infectious disease prevention and control fund,improving its action capacity,increasing necessary membership fees,and strengthening resource coordination with other international organizations are all feasible ways to improve the existing difficulties.
