混剪视频著作权保护的制度困境与纾解之道

摘　　要：混剪视频的风靡伴随着著作权困境,其存在与发展受到不当阻碍,基于文化多样性、表达自由和知识创新等的价值考量,著作权法应为混剪视频的发展留有制度空间。对于业余的混剪视频,可通过对合理使用这一公共领域制度的改造为其生存护航,可行的途径是对适当引用型合理使用进行合理解释,以扩大其适用范围,从而为混剪视频的创作开道;对职业混剪视频,则可通过默示许可制度之再造提高许可使用效率,以平衡权利人与使用者间的利益分享,最终实现互联网时代的知识创新、新技术革命和文明传播的有机统一。Based on the values of cultural diversity,freedom of expression and intellectual innovation,copyright law should leave institutional space for the development of mashup video.For amateur mashup video,the public domain system of fair use can be reformed to protect their survival.A feasible way is to reasonably interpret the fair use of ap⁃propriate citation to expand its scope of application,so as to open the way for the creation of mashup video;for profes⁃sional mashup video,the re-creation of the implied license system can improve the efficiency of license use,balance the sharing of interests between right holders and users,and ultimately,it can promote the organic unity of knowledge innovation,new technology revolution and civilization dissemination in the Internet era.
