我国标准版权保护现状及新形势下的立法建议

摘　　要：本文深入分析了《世界贸易组织贸易技术壁垒协定》(WTO/TBT协定)的立法目的、该协定中技术法规与我国强制性标准和法规的语词含义差异、强制性标准和法规颁布程序的差异、目前我国对国家标准版权的司法保护等现状,提出了从立法层面将标准版权保护相关条款列入《中国著作权法实施条例》的立法建议,为完善国家标准版权全链条“大保护”的格局提出了可行的路径。This article analyzes the legislative purpose of Agreement on Technical Barriers to Trade of the World Trade Organization(WTO/TBT Agreement), the differences between technological regulations in the WTO/TBT Agreement and China’s mandatory standards and regulations, the differences in issuing procedures between mandatory standards and regulations, and the current judicial protection on the copyright of national standards. This article puts forward the legislative proposal to include the relevant provisions of copyright protection on standards in the Implementing Regulation on Chinese Copyright Law, providing a possible path to improve the “massive protection” pattern of completed national copyright protection on standards.
