摘　　要：目前,学界对碳排放权法律属性的界定尚未有统一定论,准物权说、行政规制权说、环境权说、债权说、新型财产权说等学说众说纷纭,亟待结合法学基础理论妥当厘定。在国内层面,碳排放权主体是企业事业单位,而在国际层面,则是以国家主体为第一序位、企业事业单位为第二序位的复合主体。应当根据不同排放权的权利主体分置其权利属性,将碳排放权法律属性二元分类界定,即以国家为权利主体的发展权和以企业事业单位为权利主体的用益物权。碳排放权立法应当在国际和国内两个维度展开,形成国际与国内碳排放权的法治互动,同时强化权利主体的权利行使应当基于节能降碳等环保约束义务的履行。Presently,the academic circle has not yet reached a unified conclusion on the demarcation of legal attributes of carbon emission rights,which are demarcated as quasi-property rights,or administrative regulation rights,or environmental rights,or creditor’s rights,or new-type property rights.It is urgent to properly demarcate their legal attributes in conjunction with the basic theories of law.At the domestic level,the subject of carbon emission rights is the enterprises and public institutes,while at the international level,it is a composite subject with the country as the first order and the enterprises and public institutes as the second order.The legal attributes of carbon emission rights should be demarcated in a binary manner according to their different rights subjects,that is,the right to development with the country as the subject and the usufructuary right with the enterprises and institutes as the subject.The legislation of carbon emission rights should be carried out at both international and domestic levels,forming the legal interaction between international and domestic carbon emission rights,and meanwhile emphasizing the fact that rights of the subject should be exercised based on the performance of environmental protection obligations such as energy saving and carbon reduction.
