摘　　要：知识产权专门法院建设是我国经济社会高质量发展阶段的客观要求,是司法改革推动的必然结果,也是参与知识产权国际治理的现实需要。包括知识产权法院在内的知识产权司法体系实践成果丰硕,案件集中管辖为确保国家知识产权政策落地奠定了坚实基础,专门化审判改革为知识产权保护水平提升提供了必要条件,裁判规则输出和专门职能发挥为创新发展提供了重要保障,并培养了一批专业化职业化的知识产权司法人才队伍。但同时,知识产权法院建设还面临资源保障不足、专门程序缺乏、管理体制不合理、作用发挥不充分等问题。但这些问题并非改革造成的结果,而是改革不充分不到位的表现,应通过进一步改革破局,以知识产权强国建设为目标,坚持知识产权保护司法主导理念,健全专门审判体系,探索专门诉讼制度,创立专门管理机制,加强源头治理,提升司法能力,发挥服务保障高质量发展的职能作用。The construction of Intellectual Property(IP)courts is an objective requirement of the high-quality development of China's economy and society,an inevitable result of the promotion of judicial reform,and a practical need to participate in the international governance of intellectual property.The IP judicial system,including IP courts,has achieved fruitful results in practice.The centralized jurisdiction of cases has laid a solid foundation for ensuring the implementation of the national IP policy.The specialized trial reform has provided the necessary conditions for improving the level of IP protection.The output of adjudication rules and the play of specialized functions have provided an important guarantee for innovation and development,and a number of specialized and professional IP judicial talents has been cultivated.Meanwhile,the construction of IP courts is also faced with problems such as insufficient resource guarantee,lack of special procedures,unreasonable management system and insufficient role playing.However,these problems are not caused by the reform,but the manifestation of inadequate reform.We should break the situation through further reform.Adhering to the judicial leading concept of IP protection,we should improve the special trial system,explore a special litigation system and create a special management mechanism.We should also strengthen source governance,improve judicial capacity,and play a functional role in providing services to ensure high-quality development.
