摘 要:司法审查是规范行政行为的重要手段之一,可有效规范失信行政惩戒。目前我国失信行政惩戒司法审查主要采取部分审查的模式,未实现全面实质性审查,因此法院在司法审查时应细化审查主体,明确个案惩戒行为性质,加强对失信行政惩戒程序的审查,给予行政机关适度的裁量空间,充分实现行政程序的价值保障功能。During the construction of social credit system in China,the administrative punishment mechanism for dishonesty has gradually formed.While improving the administrative punishment system for dishonesty,the problem of abuse of power in practice cannot be ignored.Therefore,it is necessary to study the normative issue of administrative punishment for dishonesty from the perspective of power restriction.Judicial review is one of the important means of regulating administrative behavior,and can effectively regulate administrative punishment for dishonesty.At present,the judicial review of administrative punishment for dishonesty in China mainly adopts the mode of partial review,which has not achieved a comprehensive substantive review.Therefore,the court should refine the subject of review during judicial review,clarify the nature of individual disciplinary actions,strengthen the review of administrative punishment procedures for dishonesty,and give administrative give administrative organs appropriate discretion space,so as to fully realize the value guarantee function of administrative procedures.
