“一带一路”国际投资便利化问题探析

摘　　要：随着“一带一路”倡议的深入推进,越来越多的外国企业向中国企业投入资金,中国企业也日益加快走出国门的步伐。东道国、母国和投资者都是“一带一路”沿线各国投资便利化的主要推动者。“一带一路”沿线的投资问题涉及不同国家之间的资本流通,资本的流通过程较复杂,资金流通过程中存在的问题也较多。这些问题主要包括投资范围受限、信息交流不畅、纠纷解决困难、全球化进程受阻四方面的内容。基于上述情况,改善投资环境,破除交流壁垒,创新纠纷解决机制,坚持全球化战略成为解决“一带一路”国际投资便利化问题的必然选择。值得注意的是,在解决沿线国家投资问题时要注意运用法律思维,根据现实需要在沿线各国之间订立多边条约或者增补现行条约的内容。各国应当利用法律工具巩固彼此之间的合作关系,保障投资便利化目标的顺利实现。With the deepening of the“Belt and Road”initiative,more and more foreign enterprises are investing in Chinese enterprises,and Chinese enterprises are accelerating their pace of going abroad.Host countries,home countries and investors are all major drivers of investment facilitation in countries along the“Belt and Road”.The investment issues in countries along the“Belt and Road”involve the capital circulation among different countries.The capital circulation process is complicated and filled with many problems.These problems mainly include limited investment scope,poor information exchange,difficulties in dispute resolution,and obstacles in the process of globalization.In view of the above situation,improving the investment environment,breaking down communication barriers,innovating dispute resolution mechanisms and adhering to the globalization strategy have become the inevitable choice to solve the international investment facilitation issues of the“Belt and Road”initiative.It is worth noting that legal thinking should be applied when solving investment problems in countries along the“Belt and Road”,and multilateral treaties should be concluded among countries along the“Belt and Road”or the contents of existing treaties should be supplemented according to actual needs.Countries should use legal tools to consolidate their cooperative relations and ensure the smooth realization of investment facilitation.
