高空抛物罪“情节严重”的认定

摘　　要：高空抛物罪通过《刑法修正案(十一)》而设立,“情节严重”成为认定高空抛物罪的重要条件。在高空抛物罪设立之前,大多数高空抛物行为都被认定为以危险方法危害公共安全罪。而《刑法修正案(十一)》把高空抛物罪的法益内涵从草案中的危害公共安全性质转变为扰乱公共秩序性质。现根据高空抛物的特点及该罪名的法益内涵可知,该罪中的“情节严重”主要包括四种类型:抛掷高度较高,抛掷物重量较大,抛掷地点特殊,实际损害较重。The crime of high-rise littering was established in the“Amendment to Criminal Law(Ⅺ)”.“Cases of gross violation”have become an important condition for the conviction for the crime.Before the establishment of the crime of high toss acts,most high toss acts were deemed as crimes of endangering public safety by dangerous methods.The“Amendment to Criminal Law(Ⅺ)”changed the legal connotation of the high-rise littering crime from the nature of endangering public security in the draft to the nature of disturbing public order.According to the characteristics of high-rise littering and the legal connotation of the crime,the“cases of gross violation”in this crime mainly include four types:higher littering height,grosser littering weight,special littering location,and heavier actual damage.
