国家治理视野下检察机关法律监督的优化

摘　　要：推进国家治理体系与治理能力现代化要求检察机关优化法律监督。检察机关法律监督优化问题研究应在对国家治理现代化科学理性认知的基础上展开,厘清检察机关法律监督优化的基本逻辑则是探寻其研究路径的前提。法律词语原意解构和主体权力属性辨析作为优化检察机关法律监督的传统研究路径具有局限性。面对当前检察机关法律监督运行保障机制存在的不足,权力运行保障机制完善型研究路径作为第三种路径更加契合国家治理现代化的时代需求。检察机关法律监督的优化可以通过提升检察队伍建设专业化、深化检察法律监督一体化、推进检察财物保障法治化等权力运行保障机制的完善来实现。Modernization of state governance system and governance capacity requires procuratorial institutions to optimize legal supervision. The research on the optimization of legal supervision of procuratorial institutions should be carried out on the basis of scientific and rational understanding of the modernization of state governance,and clarifying the basic logic of the optimization of legal supervision of procuratorial institutions is the premise of its research path. The traditional research paths of deconstruction of the original meaning of legal terms and discrimination of subject power attributes have limitations.Therefore,researches on perfection of the guarantee mechanism procuratorial institution’s legal supervision is more in line with the needs of the modernization of state governance. The optimization of legal supervision of procuratorial institutions can be realized by improving the construction of a professional procuratorial team,deepening the integration of procuratorial legal supervision,and promoting the legalization of procuratorial property security.
