我国外卖骑手高温津贴权益保障的制度完善研究

摘　　要：文章通过分析我国立法、司法与学理现状,研究现阶段我国对于外卖骑手高温津贴保障达成的共识,发现我国目前外卖骑手领取高温津贴存在的问题,进而提出从提高立法层级、明确法律关系、加强部门监管、合理规划举证责任以及发挥行业工会作用等建议来保障外卖骑手领取高温津贴的权益。By analyzing the current legislative,judicial and academic situation in China,this paper studies the consensus reached on the guarantee of high-temperature allowance for take-away riders at this stage,and finds out the existing problems of the riders’ high-temperature allowance in China.Then,it puts forward some measures to protect the rights and interests of the riders’ high-temperature allowance,such as improving the legislative level,clarifying the legal relationship,strengthening the supervision of administrative departments,rationally planning the burden of proof and giving full play to the role of trade unions.
