论离婚冷静期法律价值的区别对待

摘　　要：离婚冷静期的设立是为了实现秩序、权利、自由、正义、平等、效率等法律价值,但是由于离婚的原因和情形各不相同,并非每种情形的离婚冷静期都能实现法律价值。离婚冷静期,应考虑到法律一般性与其所规范的法律行为具体性之间的缝隙,在一般性的规定中要考虑到具体法律行为的特殊性,应由千篇一律改为区别对待,修改的依据就是离婚冷静期对于每种协议离婚情形所具有的法律价值:有一般价值的保持,无价值或有负价值的剔除,有重要价值的延长。对于离婚冷静期的法律价值冲突,不是简单地取舍,而是进行价值整合,谋求价值总量的最大化。The establishment of the divorce cooling-off period is to realize the legal value of order,rights,freedom,justice,equality,efficiency,etc.However,because the reasons and circumstances of divorce are different,not all divorce cooling-off periods in each case can realize the legal value.The divorce cooling-off period shall take into account the gap between the generality of the law and the specificity of the legal acts regulated by it.In the general provisions,the particularity of the specific legal acts shall be taken into consideration,and the rules shall be changed from one to the other.The basis for the modification is the legal value of the divorce cooling-off period for each type of divorce agreement:the maintenance of general value,the removal of valueless negative value,and the extension of important value.
