摘　　要：发生在人群密集场所的高空抛物行为,施于公共场所,指向公众中不特定的人,任何一个人都可能成为受害者,这打破了公众生活的平稳和安宁,体现了“公共”的社会性,再加上其有导致不特定人伤亡的具体危险,与放火、爆炸等行为危险性相当,具有危害公共安全的性质,适用以危险方法危害公共安全罪不存在法理上的障碍。《刑法修正案(十一)》增设高空抛物罪并非对以往《意见》的否定,将高空抛物罪定位为抽象危险犯的直接起因涉及回应民意和现象立法,但同时具有深层的理性依据,即基于个人安全需要-免予恐惧的权利-他人行为义务的逻辑链条,为维护保护法益所必须的社会秩序,立法者改变了依照具体危险犯惩罚行为的司法套路。The behavior of throwing objects from a height happened above crowded places is applied to public places,pointing towards unspecified people in the public,and anyone may become a victim,which breaks the stability and tranquility of public life and reflects the sociality of“public”.In addition,it has the specific risk of causing casualties to unspecified people,which is equivalent to the risk of arson,explosion and other behaviors,and has the nature of endangering public safety.There are no legal obstacles to the application of the crime of endangering public security by dangerous methods.The addition of the crime of throwing objects from a height in Amendment(XI)to the Criminal Law is not a negation of the previous opinions on hearing cases of throwing objects from a height.The direct cause of positioning the crime of throwing objects from a height as an abstract potential damage involves responding to public opinion and phenomenal legislation,but it also has a deep rational basis.Based on the logical chain of personal security needs the right to be free from fear the obligation of others'behaviors to maintain the social order necessary to protect legal interests,legislators have changed the judicial routine of punishing behaviors according to specific potential damage.
