摘 要:对监督者的监督需要权力监督与权利监督双向驱动。当前,权力监督体系已初步形成,但制度实效仍存缺憾,亟须构建针对监察机关的职务违法监察行为的权利监督机制。与西方国家权力资源配置方式不同,我国是人民主权之下的“权能分工”模式,对公权力的司法审查模式也并非只有西方化的行政诉讼这唯一路径。监察权能具有独立的宪法地位,传统的“特别权力关系理论”与依法监察原则相悖,监察行为的本质属性也决定了其理应受到司法权能的制约。独立的监察诉讼制度具有“权力监督权力”以及“权利监督权力”的双重价值面向,可以实质性破解“如何监督监督者”的制度困境。The supervision of the supervisor requires the two-way drive of power supervision and right supervision.At present,the power supervision system has been initially formed,but the effectiveness of the system still has shortcomings,which needs to be remedied urgently.There is still a lack of supervision over the rights of the supervisory organs’duty violations,which in an urgent need of construction.Different from the power resource allocation mode of“separation of powers”in western countries,China has a mode of“division of powers and functions”under people’s sovereignty,and the judicial review mode of public power is not the only path of Westernized administrative litigation.Supervisory power has an independent constitutional status,and the traditional theory of special power relations is also contrary to the principle of legal supervision.The essential attribute of supervisory behavior also determines that it should be restricted by judicial power.The independent supervision litigation system has the dual value orientation of“power supervising power”and“right supervising power”,so as to solve the institutional dilemma of“how to supervise the supervisor”with the independence and confrontation of power supervision and the normality of right supervision.
