侵害民警执法权益案件的现状及其防范策略——以广东省X市侵害民警执法权益案件的调查为例

摘　　要：侵害民警执法权益的案件屡有发生,不仅损害了民警的执法权益,而且严重侵犯了公安机关和国家法律的权威。民警维权机制从系统角度来看,除了案发后采取依法打击侵害民警执法权益行为的积极措施维护民警权益外,可建立风险预警机制,制定处置相关警情的实战指引,开展切实有效的能力培训,采取普法教育的措施,为切实预防和减少侵害民警执法权益案件的发生提供保障。Cases of infringement of police’s law enforcement rights and interests occur frequently,which not only damages police’s law enforcement rights and interests,but also seriously infringes the authority of public security organs and national laws.From a systematic point of view,the police rights protection mechanism,in addition to taking active measures to protect the rights and interests of the police after the incident,establishes the concept and mechanism of prevention in advance,such as establishing a risk early warning mechanism,formulating practical guidelines for dealing with related police situations,carrying out practical and effective ability training,and taking measures of law popularization education,to ensure that the police are in a good law enforcement environment.
