摘　　要：在智能传播时代,遏制网络版权侵权是版权治理体系和治理能力现代化的重要组成部分。“技术是一把双刃剑”,由新媒体技术引发的版权诉讼,也可以由新技术予以解决。面对网络传播中版权侵权诉讼提供证据难的问题,“可信时间戳”为解决这一难题提供了司法案例和实践方案。其中,“咪咕传媒案”就是一起典型的运用“可信时间戳”的网络版权侵权案例。我们有必要在认识可信时间戳技术以及应用现状的基础上,以“咪咕传媒案”为主要分析对象,探讨“可信时间戳”在网络版权治理中所存在的焦点问题以及这一技术对未来网络版权治理的影响,以期为互联网空间中的版权司法治理提供学术智慧。In the era of intelligent communication,curbing online copyright infringement is an important part of the modernization of copyright governance system and governance capabilities."Technology is a double-edged sword".Copyright lawsuits caused by new media technology can also be solved by new technology.Faced with the difficulty of providing evidence for copyright infringement lawsuits in Internet communication,"Trusted timestamp"provides judicial cases and practical solutions to this problem.The"Migu Media Case"is a typical online copyright infringement case using"trusted timestamp".On the basis of understanding the technology of trusted timestamp and its application status,it is necessary to take the"Migu Media Case"as the main object of analysis,to discuss the focal issues of trusted timestamp in Internet copyright governance and the impact of this technology on the Internet copyright governance in the future.We hope to provide academic wisdom for the judicial governance of copyright in the Internet space.
