摘　　要：著作权商业代理机构开展集体管理活动的合法性在著作权法实践中并未形成共识,以致此类著作权交易面临侵权风险。《著作权集体管理条例》关于集体管理主体资格的限制规范是管理性强制性规定,并不影响商业代理机构依照著作权人的授权开展代理行为的效力。只有商业代理机构滥用集中管理的著作权,扰乱著作权交易市场秩序,才构成违法。There is still no consensus over the legitimacy of collective management activities carried out by a commercial agency of copyright in the practice of copyright law,so that such copyright transactions face the risk of infringement.The restrictive regulation on the subject qualification of collective management in Regulations on the Collective Management of Copyright is management mandatory provision,which does not affect the effectiveness of agent behavior carried out by commercial agency in accordance with the authorization of copyright owners.Only when a commercial agency abuses the copyrights under collective management and disturbs the trading market orders of copyright,can it constitute a violation of the law.
