摘　　要：网络时代下,互联网社交平台作为新兴的舆论工具,承载了数以亿计网民的心声,成为广大民众表达民意、参与司法和监督司法的重要手段。近年来,一些案件受到了公众的广泛关注,所产生的舆论风暴对司法有不可小觑的作用。文章分析了网络舆论的形成及特点,舆论监督存在的合理性及现实困境,探讨实现舆论与司法良性互动的规制路径,以期在网络时代下追求司法独立的同时又能够温暖人心,化解舆论与司法的冲突,共同实现社会的公平正义。In the Internet age,as a new tool of public opinion,Internet social platform carries the voice of hundreds of millions of Internet users.It has become an important means for the general public to express public opinion and participates in justice and supervise justice.In recent years,some cases have been widely concerned by the public,and the storm of public opinion has played an important role in the administration of justice.This paper analyzes the formation and characteristics of network public opinion,the rationality and practical difficulties of public opinion supervision,and discusses the regulatory path to realize the benign interaction between public opinion and justice,in order to warm people's hearts while pursuing judicial independence in the network era,resolve the conflict between public opinion and justice,and jointly realize social fairness and justice.
