摘 要:新冠肺炎疫情的发生给我国社会带来巨大的冲击,也给和谐劳动关系构建带来严重挑战。一方面劳动形态的多元化将深入演化和发展;另一方面劳动关系二元结构的局限性在新冠疫情中不断被放大,具体体现为各方利益不平衡、市场发展不协调、制度设计不充分。当前,追踪和把脉新冠肺炎疫情时代和谐劳动关系构建面临的问题,需要完善劳动法规体系,维护新就业形态劳动者合法权益;发挥集体协商协调劳动关系作用,积极预防和化解劳资矛盾;构建劳动争议多元化解机制,形成劳动争议多元化解格局;坚持底线思维,把促进就业作为重中之重;建立针对灵活就业群体的社会保障制度,确保灵活就业劳动者公平享受各项社会保障待遇。The occurrence of COVID-19 has brought great impact to our society, and also brought serious challenges to the construction of harmonious labor relations. On the one hand, the diversification of labor forms will further evolve and develop. On the other hand, the limitations of the dual structure of labor relations have been continuously amplified in the COVID-19, which are specifically reflected in the unbalanced interests of all parties, uncoordinated market development and inadequate system design. At present, we need to improve the labor law system and safeguard the legitimate rights and interests of workers in the new form of employment;Give full play to the role of collective negotiation in coordinating labor relations, and actively prevent and resolve labor capital conflicts;Build a mechanism for resolving labor disputes in multiple ways and form a pattern of resolving labor disputes in multiple ways;Adhere to the bottom line thinking and take promoting employment as the top priority;We will establish a social security system for flexible employment groups to ensure that flexible workers enjoy fair social security benefits.
