摘  要:自治与管制、自由权与社会权是劳动力市场灵活性与安全性的社会法学术语表达。劳动合同、劳动基准与社会保障等方面的法律规制,综合构成了影响我国劳动力市场灵活性的社会法法律框架。通过“结构性”分析方法,可发现该框架存在《劳动合同法》整体过严、劳动基准“板块化”明显、集体协商作用远未发挥、劳动力市场分割严重、兜底性社会保障不健全等问题。未来,须依托“制度协同”视角,对无固定期限劳动合同、经济补偿金、劳动合同变更、解雇保护条件等规定进行适当放松,对主体分层分类、劳务派遣岗位定性以及非全日制和新业态用工制度进行完善,对劳动基准和集体协商制度进行弹性提升。同时,须以社会保障法的完善作为托底性前提条件,实现在安全范围内增强我国劳动力市场灵活性的目的。Autonomy andregulation,liberty and social rights are the expressions of social law terms for the flexibility and security of labormarket.The legal regulation of labor contract,labor benchmark and social security etc.comprehensively constitute thelegal framework which affects labor market flexibility.Through the structural analysis method,it can be found thatthe framework has problems,such as the overall strictness of Labor Contract Law,obvious rigidity of laborbenchmark,far-from-playing of collective consultation role,serious segmentation of the labor market,imperfection ofsocial security and so on.In the future,relying on the approach of “institutional synergy”,appropriate relaxationshould be made in terms of nonfixed term labor contracts,economic compensation,labor contractmodification,dismissal protection conditions etc.;the classification of labour market main bodies,qualitative naturelabor dispatch post,part-time and new industrial employment should be improved;the flexibility in labor standardsand collective consultation system should be stengthened.Meanwhile,The perfection of social security law should betaken as the basic prerequisite to realize the purpose of enhancing the flexibility of China’s labor market within thescope of safety.
