国家公园中集体所有权的限制及其处置方式

摘　　要：采用文献研究法和归纳分析法研究了我国国家公园中集体所有权和私人所有权的限制及其处置方式,以期为《国家公园法》立法工作提供参考。研究发现:第一,我国国家公园中的集体所有权受到一定限制,其占有、使用、收益、处分权能均受到限制;第二,我国国家公园中的集体所有权限制的合理性来源于对生态环境公共利益的保护;第三,我国国家公园中所有权限制的处置方式可以分为绝对限制(如征收、赎买、置换、捐赠等)和相对限制(如设定地役权合同、租赁等)。我国国家公园中集体所有权限制的处置方式采用设定地役权合同和置换较有优势。This paper is te study the restriction and disposal methods of collective ownership and privete ownership of nationai parks in China te provide a reference for the legislative work of China's National Parks Law.The methods applied in the present study include literature research and inductive abstraction.The results show that:1)the collective ownership of national parks in China is subject to certain restrictions,and its possession,use,profit,and disposal rights are all restricted;2)the rationality of collective ownership restrictions in China's national parks comes from the protection of the public interest of the ecology and environment;3)the disposal methods of ownership in national parks of China include absolute restriction(expropriation,redemption,and replacement,etc)as well as relative restriction(easement contract and lease,etc)The disposal methods of collective ownership restriction in China's national parks are more advantageous by setting easement contracts and replacement.
