论滥用市场支配地位行为的垄断违法判定——以经济标准为中心

摘　　要：由于规范的模糊性与传统类型化方法的弊端,我国执法机关对滥用市场支配地位行为进行垄断违法判定的过程中,就是否分析“竞争效果”的态度不一。“竞争效果”分析的经济标准分为效果衡平类与特定意图类,不考虑执法错误成本,整体福利标准是理想的判定标准。实践中,应考虑执法错误成本及不同类型执法错误出现的概率对经济标准的影响。为更好地规范滥用市场支配地位的行为,未来我国应在立法上统一滥用市场支配地位行为的垄断违法判定标准,执法机关可通过选择恰当的经济标准确定调查与搜寻相关证据的方向,同时需分析经营者所处的市场结构及涉嫌滥用行为是否促进竞争,以展开对涉嫌滥用行为的违法判定。Due to the drawbacks of the ambiguity of the norms and the traditional typological approach,the enforcement authorities in China have different attitudes on whether to analyze the“competitive effect”in the process of determining monopoly violations for the abuse of dominant position.The economic criteria for the analysis of“competitive effect”are divided into the categories of equitable effect and specific intent,and the overall welfare criterion,without considering the cost of enforcement errors,is the ideal criterion for determination.In practical use,the impact of the cost of enforcement errors and the probability of different types of enforcement errors on the economic criteria should be taken into consideration.In order to better regulate the abuse of dominant market position,it is expected to unify the monopoly violation determination criteria for the abuse of dominant market position in legislation in the future.Meanwhile the enforcement authorities would engage the illegal determination of the suspected abuse from three aspects.It is expected to determine the direction of investigation and search for relevant evidence by choosing the appropriate economic criteria,analyze the market structure in which the operator is located and eventually judge whether the suspected abuse promotes competition.
