高空抛物罪的司法适用探析

摘　　要：高空抛物罪在司法适用过程中存在“高空”要素频繁被架空、对所抛掷物品的危险性要求过高、对行为“情节严重”说理不明等问题,本罪的保护法益不是公共安全,而是公共场所秩序。并且,对于“公共场所秩序”这一集体法益有必要还原为个人法益;本罪的归责模式既不是实害犯,也不是危险犯,而应是情节犯;本罪的构成要件亟需进一步明晰,包括本罪的犯罪客观方面、主观方面及“情节严重”的内涵。对于高空抛物行为的罪数问题,应重点关注本罪与以危险方法危害公共安全罪的关系,以及本罪与其他致人伤亡犯罪的想象竞合情形。There are some problems in the judicial application of the crime of throwing object at high altitude.Height,as a constitutive element of the crime,is frequently ignored.The judicial office makes enormous demands on the object’s potentiality of danger and does not clearly explain the circumstances of the crime.The legal interest infringed by this crime is not public security but the order of public site.Moreover,“the order of public site”is a collective legal interest,which needs to be restored to personal legal interest.The crime of throwing object is neither actual damage offense nor potential damage offense;in fact,it’s circumstances offense.The constitutive requirements of this crime are necessary to be clear,which include the objective aspect of the crime,the subjective aspect of the crime and the connotation of“critical circumstances”.As for the quantity of crime,the relation between this crime and the crime of endangering public security by other dangerous means should be focused upon.The circumstance of imaginative joinder of offenses caused by this crime and other crimes that result in people’s injury or death need also be concerned.
