依据法治和德治相结合原则治理“饭圈”乱象

摘　　要：“饭圈”乱象是一种前所未有的违德和违法相互交织的社会现象。它既违反了社会主义核心价值观,又违反了我国《未成年人保护法》《家庭教育法》《网络安全法》等法律。治理饭圈乱象,要坚持法治和德治相结合原则。在德治方面,应从三个角度强化教育:行为底线角度,加强对中小学教师、未成年人及其家长的民法知识教育,使人们懂得未成年人的行为是有底线的,不能随心所欲,普及人格权方面的民法知识,不要把正常的明星崇拜弄成非理性的个人迷信,更不能不允许别人批评自己的偶像;媒体报道角度,加强媒体对明星公众人物的正面报道和监督性报道,使未成年人全面认识明星的优点和缺点;平台规范角度,要加强平台自律公约的建设。在法治方面,防止“饭圈”注册为合法社团;形成中央网信办牵头抓总、各个行政部门各司其职、家庭主导、社会协同、执法司法机关守住最后防线的治理“饭圈”的体制;强化依法治理“饭圈”,要制定网络净化法,将治理“饭圈”乱象的“清朗”专项工作常态化、制度化。This paper argues that the fan community phenomenon is a social pathology in which violation of morality and illegality are intertwined. Many behaviors among fan communities violate not only socialist core values,but also national laws such as Minor Protection Law,Family Education Law and Network Security Law.To regulate fan communities,we must combine rule of law with rule of virtue. In the aspect of rule of virtue,we shall raise awareness of civil law among primary and secondary school teachers,minors and their parents,so that people understand that certain behaviors of fan communities are illegal. We shall educate minors about personality rights,so that they can understand that they shall not turn fandom into irrational personality cult,and that they shall allow others to criticize their idols. It is necessary to regulate the media coverage of celebrities,to help minors comprehensively see the strengths and weaknesses of stars. It is also necessary to promote platform self-regulate rules. Under the leadership of the Central Cyberspace Administration of China,administrative agencies should perform their own duties and jointly regulate fan communities with the families,society,judicial organs,and law enforcement agencies. It is necessary to enact internet purification laws,and normalize and institutionalize the “clean internet campaign”which aims to regulate fan communities.
